2nd trial set for trooper accused of fondling

A Mississippi Highway Patrol officer accused of fondling a child was set to stand trial Monday for a second time.

Master Sgt. Richard Dane Davenport is accused of fondling or touching a child under the age of 16 in Oktibbeha County. His first trial ended in a mistrial, which came as the jury heard inadmissible testimony from the child, in October 2008.

The 45-year-old officer faced similar charges in Warren County, but that case also ended in a mistrial in September.

Prosecutors had alleged the fondling incident, involving a young boy, occurred Sept. 23, 2007, while Davenport was in town to attend a Mississippi State football game.

Davenport, a 20-year highway patrol veteran, remains on unpaid administrative leave.
