Case may be moved to federal court

According to documents filed on Dec. 3, 2013 in federal court, attorneys for Kingsbridge Holdings, LLC., a defendant in a lawsuit filed by the Pearl River County Hospital, have filed a motion requesting the case be transferred to the U.S. District Court of Southern Mississippi.

The lawsuit, which was filed on Nov. 1, 2013 in Pearl River County Circuit Court by the hospital, claims that Kingsbridge and others engaged in a conspiracy to defraud the hospital and Medicare of money.

According to the motion, Kingsbridge Holdings, LLC.’s attorneys wrote that since the “rights and duties arise from the federal law, are federal in nature” then “federal question jurisdiction exists over this action.”

Attorneys for the hospital filed a counter motion to remand the case to circuit court on Jan. 2, 2014.

Kingsbridge has also filed a claim against Colette Oldmixon, Steve Vaughn, Scott Alsobrooks, Rita Jones, Lucian Roberson, and Dawn Stuit, “to pay part or all what the defendant may owe” to the hospital.

A federal judge has made no decision whether to proceed in federal court or return the case to circuit court.
